Thank you for visiting the website of the public organization “Techiia Fundation”.

NGO “Techiia Fundation” (hereinafter – “Techiia Fundation” or “we”, “us”, “our”) is a Ukrainian non-profit organization. Our website https://techiia-fund.org/ (hereinafter referred to as the “Website”) is intended for charitable activities, as well as for users who wish to provide the Charitable Donation or otherwise assist the Techiia Fundation in achieving the goal(s) of its
activities. 

We focus on charitable activities in the areas of social protection and social security, as well as promoting the defense capability and mobilization readiness of Ukraine, protection of the population in emergency situations of peace and martial law, in particular:

  • Support for freedom and defenders of Ukraine;
  • Helping children;
  • Assistance to hospitals;
  • Education of children and students.

Please read these Website Terms of Use (hereinafter - the “Terms”) carefully before using the Website or making charitable donations.

By accessing the Website and using it in the future, the User acknowledges and certifies that he/she has read and agrees to these Terms and the Privacy Policy, which constitute a complete legally binding agreement regarding the terms and conditions of the Website use and understands their content and undertakes to comply with their provisions in full.

1 Terms used in these Rules

 

the Benefactor – the person who provide the Charitable Donation.

the Charitable Donation is a voluntary and free transfer by the Benefactor to the Techiia Fundation of funds and other property to achieve the goals and objectives of the Techiia Fundation.

the Content – is all objects and materials without limitation placed on the Website, including information, texts, images, animations, titles, logos, banners, slogans, audio and video recordings, design, graphics, illustrations, interface, etc.

the Privacy Policy is an integral part of the agreement between Techiia Fundation and the User regarding the use of the Website. The Policy explains how and for what purpose Techiia Fundation uses your personal data obtained in connection with the use of the Website. 

the Public offer – is a public offer of the NGO “Techiia Fundation” for an unlimited number of persons to conclude an agreement on the provision of Charitable Donation, available at the link: https://techiia-fund.org/en/public-offer.

the Recipient – is a person who needs the Charitable Donation within the scope of the goals and objectives of the Techiia Fundation, and to whom such assistance is directly provided. 

the User – a person who uses the Website, including the Benefactors, the Volunteers, the
Recipient, depending on the circumstances. The text may also be used as “you”.

the Use of the Website – the User's access to this Website, viewing and interacting with the elements of the Website, visiting pages, sections of the Website, interacting with the Content of the Website, using the functionality of the Website and / or performing other actions available to Users through the Website.

the Volunteer – is a natural person who voluntarily carries out socially oriented non-profit
activities aimed at helping to achieve the goals and objectives of the Techiia Fundation.

the Website – is a website available under the domain: https://techiia-fund.org/, on which the Techiia Fundation posts information about its activities, the Content, areas of Charitable Donation (projects, tasks), and also provides an opportunity to join the charity activity.

2 To help

Through the Website, the Users can provide the Charitable Donation assistance to the Techiia Fundation. The legal relationship between the Techiia Fundation and the Benefactors is determined by the agreement concluded by acceptance of the Public Offer by the Benefactor.

At the same time, we would like to inform you that according to the Resolution of the Cabinet of Ministers of Ukraine No. 202 dated March 5, 2022, the requirements established by law for the receipt, use, accounting and reporting of Charitable Donation from legal entities and individuals - residents and non-residents do not apply during martial law.

Please note that payments through our Website are sent to our bank accounts and secured by payment service providers over which we have no control, namely WayForPay (Financial Company “Way For Pay” LLC) and PayPal. Once you click on the payment link, you must comply with the terms of use, privacy policies and other policies of such payment service providers. Techiia Fundation is not responsible for the services provided by third-party websites and services.

3 Get help

In order to contact us for assistance, please fill out the application here.

You agree that if necessary, we may contact you for additional clarification and confirmation of the data provided.

We do not guarantee that you will receive the necessary assistance in full and in a timely manner, as it depends on the Charitable Donation provided by the Benefactors and the queue of persons applying for assistance.

4 The Volunteers

You can help not only by making a donation, but also by volunteering.

To become our volunteer, please send us an email to info@techiia-fund.org. We will contact you and tell you how and when you can help Techiia Fundation in its charitable activities.

5 Intellectual property rights

The Website is owned and controlled by the Techiia Fundation.

The Website or any of its individual parts are available for use exclusively for its direct functional purpose and for personal purposes.

The exclusive intellectual property rights to the Website, including without limitation the software, code, the name of the Website and the Website’s Content, as well as trademarks (hereinafter referred to as the “Intellectual Property”) belong to the Techiia Fundation and/or its licensors, unless otherwise expressly stated on the Website, and are protected by the laws of Ukraine.

It means that by default you may not use the Intellectual Property in any way, including, but not limited to, reproducing, publishing, transmitting, distributing, modifying, creating derivative works, unless expressly stated otherwise by us.

In case of citing the materials of the Website or other free use of Intellectual Property in accordance with the Law of Ukraine “On Copyright and Related Rights”, a link to the web page of the Website, the Content of which is used, indicating the full name of the NGO “Techiia Fundation”, authors (if indicated), date and year of publication is required.

If you reproduce the Intellectual Property in whole or in part for your personal or family use, you do not acquire any rights in such Intellectual Property. 8 Changes to the Terms of Use of the Website

Techiia Fundation has the right to unilaterally change these Terms at its own discretion and at any time.

All changes to the Terms come into force from the moment of their publication on the Website and are binding on all Users.

Notification of Users about changes to the Terms is the publication of a new version of the Terms on this Website. We recommend that Users check this section of the Website from time to time and pay attention to the changes made. We may also inform you of changes from time to time in pop-up windows on the Website or by other available means.

Your continued use of the Website after the changes to the Terms mean that you agree to such Terms.

We may also update and/or change our Website and any of its Content from time to time.

9 Final provisions

These Terms shall be governed and interpreted in accordance with the provisions of the current legislation of Ukraine. However, if the User has used this Website in violation of the laws of another state, we reserve the right to protect our legitimate interests in this state in accordance with its legislation.

If any provision of these Terms is found to be illegal, invalid or unenforceable, the remaining provisions of these Terms shall remain in full force and effect.

The printed version of the Website and these Terms and any notices provided in electronic form is admissible evidence in court to resolve a dispute that may arise on the basis of or in connection with the use of the Website.

In case of publication of the Terms in different language versions, the Ukrainian version will prevail.
